FEBRUARY 27, 2023 - CONSENT AGREEMENT AND FINAL ORDER
On April 21, 2020, the EPA received information and records that were reviewed to evaluate the Respondent?s compliance with the requirements of 40 C.F.R. Part 745, Subpart F. Based on review of the information and records received, the EPA determined that the
Respondent had entered into contracts to sell the residential dwellings that are target housing at several locations. Based on the EPA?s review of information received and the Respondent?s records, the EPA has determined that prior to entering into contracts to sell the residential dwellings that are target housing listed in paragraph 33 under which the purchasers became obligated to purchase the
target properties, the Respondent failed to:
a. Provide the purchasers with the EPA-approved lead hazard information pamphlet in violation of 40 C.F.R. ? 745.107(a)(1);
b. Permit the purchasers a 10-day period, or a written, mutually agreed upon different time period, to conduct a risk assessment or inspection for the presence of lead-based paint and/or lead-based paint hazards, or receive written notice by the purchaser that they have waived the opportunity to conduct the risk assessment or inspection in violation of 40 C.F.R. ? 745.110(a);
c. Include as an attachment to the contracts to sell target housing, the appropriate Lead Warning Statement in violation of 40 C.F.R. ? 745.113(a)(1);
