During the week of March 27, 2023, a Proposed Administrative Compliance Order (AO) was issued to John P. Long, Jr., (Respondent). The AO alleges Respondent violated regulations set forth at 40 C.F.R. ?? 147.2903, 147.2907, and 147.2909 through 147.2918, by failing to successfully demonstrate mechanical integrity. This compliance order requires Respondent to successfully demonstrate mechanical integrity, plug the well or convert it to production use. Comments will be solicited for 30 days from the date of this notice.
Pursuant to Section 1423(c)(3)(A) of the Act, 42 U.S.C. ? 300h?2(c)(3)(A), on March 31, 2023, EPA issued a Proposed Administrative Order to Respondent and provided Respondent an opportunity to request a hearing on the Proposed Administrative Order.
On March 29, 2023, EPA provided public notice of its proposal to issue an order for compliance in this matter in accordance with Section 1423(c)(3)(B) of the Act, 42 U.S.C. ? 300h-2(c)(3)(B). Respondent did not request a hearing and EPA did not receive any public comments on the Proposed Administrative Order. Therefore the Final Order is issued
