REGION REFERS MATTER TO DEPARTMENT OF JUSTICE SEEKING LONG-TERM ACCESS TO FORMER CHINA MANUFACTURING PLANT IN FALLS CREEK, PENNSYLVANIA
By letter dated March 9, 2023, Region III referred a case to the DOJ requesting an in rem action for access to perform long-term remedial work at a portion of property within the fund-lead Jackson Ceramix Site located in Falls Creek, Pennsylvania. Access is primarily needed to design and construct two remedies selected pursuant to 42 USC 9604(a) and 40 CFR ? 300.435. Despite extensive efforts to locate the owner of the property to obtain consent for access, no owner has been located.
