Summary

On March 28, 2023, the Regional Judicial Officer executed a Final Order ratifying the Consent Agreement entered into by the Director of ECAD and Central Hampshire Public Service District ( Respondent ) for violations of its NPDES permit (NPDES Permit # WV0081850) effluent discharge limitations at the Frenchburg Wastewater Treatment Plant (?WWTP?) located in Augusta, WV (the Facility ). Respondent is the owner and operator of the WWTP that discharges treated domestic wastewater from the Facility into Little Cacapon River, which flows into the Potomac River. Respondent had three (3) permit effluent limit exceedances from the Facility from March 2019 through April 2020 consisting of fecal coliform and suspended solids. In addition, the Respondent was collecting effluent biochemical oxygen demand (BOD) samples at Outlet 001 after disinfection and not at a location immediately preceding disinfection as required by Section A.001of the Permit. Under the terms of the Consent Agreement and Final Order, Respondent will pay a civil penalty of $7,500. EPA has coordinated with the West Virginia Department of Environmental Protection throughout the enforcement process. The EJSCREEN assessment indicates that the Facility is NOT located in an area of potential EJ concern. This Consent Agreement and Final Order initiates and concludes this penalty action.
