On March 31, 2023, Region 3 issued a CAFO that commenced and concluded a matter against Chemalloy Company LLC ( Chemalloy ), an industrial manufacturer of custom sized alloys, metals, minerals, and chemicals, to address industrial stormwater NPDES permit violations at its facility located at 1301 Conshohocken Road, Conshohocken, Pennsylvania (the Facility ). The cited violations include (1) failure to update preparedness, prevention, and contingency plan; (2) failure to conduct training; (3) failure to implement proper operation and maintenance measures; (4) failure to implement pollution prevention and exposure minimization measures; (5) failure to implement spill prevention and response measures; (6) failure to ensure good housekeeping; (7) failure to conduct routine inspections; and (8) failure to submit annual reports. The CAFO settles the violations with a civil penalty of $40,000. The CAFO is subject to public comment and received no comments. The Facility is in an area of EJ concern. None of the primary EJ Indexes are at-or-above the 80th percentile in the nation or in the state for the area; however, several environmental indicators of potential exposure are at-or-above the 80th and even 90th percentiles in the nation and/or the state. These environmental indicators include wastewater discharge. An action such as this could help protect the waterways of the EJ community. EPA has consulted with PADEP during the development of this action.
