On 1/19/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning (NOW) under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Arkansas Chemical Specialties Inc., d/b/a Chemstation of the Ozarks Inc., of Springdale, AR. The EPA alleges that Arkansas Chemical Specialties violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit a pesticide production report for the 2021 calendar year by the due date of 3/1/22. Repeat violations could subject Arkansas Chemical Specialties to a civil administrative penalty, or other actions.
The NOW was originally issued with the docket number FIFRA-06-2023-0511. The EPA later updated the docket number to FIFRA-06-2023-0311 (letter sent to Arkansas Chemical Specialties on 4/3/23).
