On April 5, 2023, EPA issued a Clean Water Act (CWA) Administrative Order for Compliance (Order) to BI-QEM Inc., a plastics manufacturing facility in Northhampton, Massachusetts. The Order addresses the company's non-compliance with conditions of the National Pollutant Discharge Elimination System (NPDES) Multi-Sector General Permit (MSGP) for Stormwater Discharges Associated with Industrial Activity and the NPDES Noncontact Cooling Water General Permit for Massachusetts and New Hampshire. The Order requires BI-QEM to perform required monitoring, amend incorrect discharge monitoring reports, perform good housekeeping and maintenance, and routinely inspect its facility as required by the MSGP. The NPDES program has not been delegated to Massachusetts, but the Massachusetts Department of Environmental Protection supports issuance of this Order.
