On 2/23/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Waco Bottling LLC of Woodway, TX. The EPA alleges that Waco Bottling violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit pesticide production reports for the 2019 and 2021 calendar years for its Woodway, TX facility by the applicable due dates; and for failing to submit pesticide production reports for the 2020 and 2021 calendar years for its Waco, TX facility by the applicable due dates. Repeat violations could subject Waco Bottling to a civil administrative penalty, or other actions.
