Summary

On April 18, 2023, the Region issued an Administrative Compliance Order to the town of Rutland citing its failure to screen all relevant outfalls/interconnections for the presence of dry-weather flow by July 1, 2021, as required by the 2016 MS4 permit. The Order requires Rutland to submit electronic copies of all existing dry-weather screening information for any of the town's MS4 outfalls/interconnections; submit a schedule to complete all dry-weather screening of its MS4 outfalls/interconnections not yet screened; and implement the schedule subject to any modifications from EPA within 30 days of receipt of the Order. According to EPA's EJ Screen application, the town does not meet EPA's definition of an area indicating potential EJ concerns. The Region coordinated with the Massachusetts Department of Environmental Protection on this matter.
