The respondent violated Section 311(b) the Clean Water Act when a harmful quantity of crude oil was discharged from a ruptured pipeline operated by respondent into Mill Creek, a perennial stream. The discharge has caused an imminent and substantial threat to the public health or welfare of the United States, including fish, shellfish, wildlife, public and private property, shorelines, habitat, and/or other living and nonliving natural resources under the jurisdiction or control of the United States
