On 2/23/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Obsidian Chemical Solutions LLC of Midland, TX. The EPA alleges that Obsidian Chemical Solutions violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit pesticide production reports for the 2019, 2020, and 2021 calendar years by the applicable due dates. Repeat violations could subject Obsidian Chemical Solutions to a civil administrative penalty, or other actions.
