On 2/23/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Ellatair LLC of Katy, TX. The EPA alleges that Ellatair violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit pesticide production reports for the 2019, 2020, and 2021 calendar years by the applicable due dates. Repeat violations could subject Ellatair to a civil administrative penalty, or other actions.
