On 2/24/23, the Environmental Protection Agency (EPA), Region 6, issued a Formal Notice of Warning under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Ag-Co Chemical LLC of Lubbock, TX. The EPA alleges that Ag-Co Chemical violated Section 12(a)(2)(L) of FIFRA, 7 U.S.C. Section 136j(a)(2)(L), by failing to submit pesticide production reports for the 2020 and 2021 calendar years by the applicable due dates for its two Lubbock, TX facilities, and also for its Shallowater, TX facility. Repeat violations could subject Ag-Co Chemical to a civil administrative penalty, or other actions.
