On 5/16/23, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) to Steven Terrell Construction Services LLC (Respondent) of Belle Chasse, LA, for alleged violations of the Toxic Substances Control Act (TSCA) The EPA alleges that Respondent has violated Section 409 of TSCA, 15 U.S.C. Section 2689, by failing to comply with the regulatory requirements of the Lead-Based Paint Renovation, Repair and Painting (RRP) Rule at 40 C.F.R. Part 745, Subpart E. Specifically:
1. Failure to obtain certification from the EPA prior to performing a renovation at a property.
2. Failure to assign a certified renovator to the renovation at the property.
3. Failure to failures to ensure that the renovation performed at the property was performed in accordance with the work practice standards in 40 C.F.R. Section 745.85.
4. Failure to provide the required EPA pamphlet to the owners of the Property prior to the beginning of the renovation activities.
5. Failure to prepare and retain records documenting compliance with the requirements of 40 C.F.R. Section 745.85 for the renovation at the property.
Respondent will pay a civil penalty of $2,700.
