Summary

On May 3, 2023, EPA filed a Consent Agreement and Final Order against Equitrans Midstream Corporation ( Equitrans or Respondent ) pursuant to 40 C.F.R. 22.13(b) and 22.18(b) of the Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties and the Revocation/Termination or Suspension of Permits ( Consolidated Rules ), as codified at 40 C.F.R. Part 22, which both initiates and settles EPA's administrative penalty action, and Section 113 of the Clean Air Act ( CAA ), 42 U.S.C. 7413, for violations of Section 111 of the CAA, 42 U.S.C. 7411, and the regulations found thereunder related to Standards of Performance ( NSPS ) for Crude Oil and Natural Gas Facilities for which Construction, Modification or Reconstruction Commenced After September 18, 2015, 40 C.F.R. Part 60, Subpart OOOOa ( Subpart OOOOa ). The violations occurred at three (3) Equitrans facilities located in Pennsylvania (Kryptonite, Mojo and Pettit Stations), and two (2) facilities located in Cameron and Hastings West Virginia (Eureka Midstream LLC Carbide Station and Gathering Gamma Station) related to annual reporting of pneumatic controller deviations for Respondent's Pennsylvania and West Virginia facilities. Equitrans disclosed in their annual report that several of its natural gas-driven pneumatic controllers did not exceed the maximum natural gas bleed rates required by Subpart OOOOa, as applicable.
