2023 Administrative Consent Order ( Consent Order ) between the United States Environmental Protection Agency, Region IX ( EPA ), the Department of Navy ( Navy ), and the Defense Logistics Agency ( DLA ) pursuant to Section 7003 of the Resource Conservation and Recovery Act ( RCRA ) and Section 1431 of the Safe Drinking Water Act ( SDWA ). I am also attaching a copy of EPA's Response to Comments for the Consent Order. The Consent Order and its requirements address and prevent releases of solid and hazardous wastes and protect drinking water, natural resources, human health, and the environment pursuant to RCRA and SDWA.
The Consent Order requires Navy and DLA to take steps to ensure the safe and expeditious defueling and closure of the Red Hill Bulk Fuel Storage Facility at Joint Base Pearl Harbor-Hickam ( JBPHH ) in Honolulu, Hawai'i and requires the Navy to perform actions to ensure the delivery of a safe and resilient supply of drinking water for the Navy-owned JBPHH drinking water system. In response to public comments received on the Proposed Order, the Consent Order also provides for creation of a Community Representation Initiative to provide for more meaningful involvement of the public throughout implementation of the Consent Order.
