On May 31 2023, EPA entered into an Expedited Settlement Agreement (ESA) with L & M Fabrication and Machine, Inc. for violations of RCRA Subtitle C (Hazardous Waste Program). L & M Fabrication and Machine, Inc. brings in new steel parts, such as beams, plates, and brackets, that are cut to size and welded to form fabricated steel. The compliance issues addressed in the ESA involve the failure to operate a hazardous waste storage facility without a permit or valid exemption to the permitting requirement by failing to label SAA container and keep closed during storage, failing to keep containers of hazardous waste closed when waste is not being added or removed, and accumulating a container of hazardous waste on-site for greater than 90-days. The company has agreed to pay a civil penalty of $3,750 and has corrected the violations cited in the ESA.
