On april 20, 2023, EPA Region 6 issued a Consent Agreement and Final Order (CAFO) under its authority pursuant to Section 3008(a) of the Resource Conservation and Recovery Act (?RCRA?), 42 U.S.C. ? 6928(a)(2) to the United States Department of Veteran Affairs. The CAFO was issued in response to violations related to the facility?s failure to file an adequate and timely notification of its hazardous waste activities with the EPA or Louisiana in violation of Section 3010(a) of RCRA, 42 U.S.C. ? 6930(a). The CAFO requires the Respondent to pay a penalty of twenty-six thousand, five hundred and fifty-six dollars ($26,556) within 60 days of the effective date of the CAFO. Also, the Respondent must respond to EPA Region 6 with a statement certifying compliance with Section 3010 of RCRA and that the facility is no longer in operation for the storage of hazardous waste within 30 days of the effective date of the CAFO.
