After data mining several EPA databases it was discovered that Smitty's Supply had failed to time report several EPCRA 313 chemicals over a 5-year time period. After negotiations, settlement was reached. A $45,000 monetary penalty was accepted. In addition Smitty's agreed to conduct a SEP in the amount of $168,750 by furnishing the local fire department with much needed equipment to serve the community.
