Respondent imported misbranded pesticide devices. Entry no. CIU-51847626 included the HEPA-CARE and H1612C-UV products which were not labeled with an EPA establishment number. Entry No. CIU-51859076 included the BD2KM, PAS750, PAS2400, PRED750, and PRED1200 which were packaged with an instruction manual which included pesticidal claims and were not labeled with an EPA establishment number. A portion of the products in Entry No. CIU-51847626 were distributed after the date the importer was sent the EPA Notice of Detention. The Respondent has agreed to pay a penalty of $151,040 for the import and distribution of the products in both shipments, have replaced the instruction manual to remove the claims, and removed the products from FIFRA regulation.
