On, August 3, 2023, Region 10 Filed an administrative penalty order to Mr. Jens Schkade of Grand View, Idaho, for violations of Clean Air Act, Asbestos National Emission Standards for Hazardous Air Pollutants (asbestos NESHAP) regulations for the demolition of a former retail store. The Region alleged Mr. Schkade failed to conduct a thorough survey for asbestos, to notify EPA in advance, to remove all asbestos-containing material before intentionally burning the building debris, and to bring the waste to an approved landfill as required by the asbestos NESHAP. According to EJScreen, the demolition occurred in an area of potential EJ concern. Respondent agreed to pay a penalty amount of $88,749.
