On September 08, 2023, EPA Region 10 settled with Nichols Brothers Boat Builders for violations of the Resource Conservation and Recovery Act (RCRA) observed during an inspection at its Freeland, WA location. The self-implementing regulations of RCRA require generators of hazardous waste to manage the hazardous waste in compliance with the RCRA requirements to protect human health and the environment. EPA alleges that Nichols Brothers Boat Builders failed to properly manage dangerous waste containers, comply with personnel training requirements, make a dangerous waste waste determination and properly manage used oil containers. Under the terms of the Agreement, Nichols Brothers Boat Builders certified it has corrected the RCRA violations and paid a civil penalty of $5,375.
