On July 21, 2023, EPA issued a NORA that stated:
Based on the information provided by the importer of record or broker, EPA has made a determination that the quantities of SoPure IVF Surface Cleaner and SoPure IVF Surface Cleaner and Disinfectant contained within this import shipment are unregistered. Pesticidal claims were observed on the labels of SoPure IVF Surface Cleaner and SoPure IVF Surface Cleaner and Disinfectant. SoPure IVF Surface Cleaner and SoPure IVF Surface Cleaner and Disinfectant are not registered under Section 3 of FIFRA, and as such, are each an unregistered pesticide. The distribution or sale of unregistered pesticides, including the importation of such pesticides, is an unlawful act under Section 12(a)(1)(A) of FIFRA, 7 U.S.C. 136j(a)(1)(A).
Pursuant to the authority of Section 17(c) of FIFRA, 7 U.S.C. 136o(c), and the regulations at 19 C.F.R. 12.114, EPA Region 5 is recommending CBP Refuse Admission, to the importer of record, the quantities of unregistered SoPure IVF Surface Cleaner and SoPure IVF Surface Cleaner and Disinfectant. The importer has been advised that it must work with CBP to export or destroy the quantities of unregistered SoPure IVF Surface Cleaner and SoPure IVF Surface Cleaner and Disinfectant.
