On July 18, 2023, Region 3 entered into a RCRA 3008(h) Administrative Order on Consent (AOC) with Mountain State Carbon, LLC for the MSC Parcel, which is part of the former Mountain State Carbon Coke Plant in Follansbee, WV (Facility). The AOC provides that the company will implement, with prior EPA approval, requirements under the West Virginia Voluntary Remediation Program (VRP). This work under the VRP satisfies Corrective Action requirements related to EPA's Final Remedy and Interim Measures. Respondent began decommissioning the facility in 2022 with plans for commercial use in the future. The Facility is not located in a potential EJ area of concern.
