On September 14, 2023, EPA Region 10 issued an Administrative Penalty Order to Michael Gagliano ( Respondent ) to address Clean Water Act ( CWA ) violations at Respondent's property in Pinehurst, Idaho. Respondent's property is located within the Bunker Hill Mining and Metallurgical Complex Superfund Site. Respondent violated the Clean Water Act by discharging dredged and/or fill material into approximately 355 sq. ft. of the South Fork of the Coeur d'Alene River without authorization under CWA Section 404. Respondent has agreed to remove the unauthorized fill material and restore the structure and function of the bank of the river to support a natural channel design. Mr. Gagliano agreed to pay a penalty of $8,000.
