On August 3, 2023, EPA entered into an Administrative Order on Consent (AOC) with Boston North Hockey LLC of Tewksbury, Massachusetts, resolving alleged violations of Section 112(r) of the Clean Air Act at the Breakaway Ice Arena. This AOC stemmed from a nationally approved compliance and enforcement pilot under the CAA 112(r) General Duty Clause, which is designed to ensure that small ammonia refrigeration facilities (< 10,000 pounds) have completed process hazard reviews of their systems. EPA elected to address the violations with an AOC instead of an Expedited Settlement Agreement, as is the typical outcome of the enforcement pilot, because the Facility's two refrigeration systems each have less than 1,000 pounds of ammonia. The AOC requires Boston North Hockey LLC to complete a Process Hazard Review for each of the two ammonia refrigeration systems at the Facility with the help of a qualified expert, coordinate with local emergency responders on plans in event of an accidental release, and provide EPA with the Process Hazard Reviews, the resumes of the consultant's team, certification that it coordinated with emergency responders, and a list of expenditures associated with implementing the AOC. Massachusetts is not delegated to implement this program.
