On July 25, 2023, EPA requested U.S. Customs and Border Protection Refuse Admission of a misbranded pesticide device. EPA determined that the quantity of UV Replacement Lamps is misbranded because it was not labeled with a valid EPA Establishment Number. Further, neither the Notice of Arrival of Pesticides and Devices (NOA), EPA Form 3540-1, or its electronic equivalent in the Automated Commercial Environment (ACE) was submitted. The importation of a misbranded pesticide device is a violation of Section 12(a)(1)(F) of FIFRA. The failure to submit the NOA or its electronic equivalent is a violation of Section 12(a)(2)(N) of FIFRA.
