Summary

On August 4, 2023, EPA Region 1 entered into an Expedited Settlement Agreement with Heath Rogers d/b/a Maine Turbo Diesels, (Maine Turbo Diesels), an automotive repair shop located in Arundel, Maine, resolving violations of Section 203(a)(3)(B) of the Clean Air Act (CAA) through the sale and/or installation of aftermarket emissions tampering devices by Maine Turbo Diesels. The administrative penalty case alleged that Maine Turbo Diesels sold and/or installed 9 illegal motor vehicle parts. Under the settlement, which is authorized under the Expedited Settlement Agreement Pilot for Clean Air Act Vehicle and Engine Violations Tampering/Defeat Devices, Maine Turbo Diesels will pay a penalty of $12,555 and certify it is operating in compliance with Section 203 of the CAA. EPA, through its direct implementation authority, plays a critical role in addressing tampering and aftermarket defeat device pollutant sources. EPA has notified the Maine Department of Environmental Protection of this matter. EPA considers that resolving these violations has the potential to benefit overburdened communities because mobile sources disproportionally impact them.
