On September 27, 2023, EPA Region 10 issued an administrative penalty order to Boulder Creek Construction LLC, A Limited Liability Company of Washington ( Boulder Creek Construction ) located in Vancouver, Washington, for violations of TSCA's Lead-Based Paint Renovation, Repair, and Painting (RRP) Rule occurring in Portland, Oregon. EPA Region 10 alleged Boulder Creek Construction failed to obtain initial RRP firm certification prior to offering, performing or claiming to perform renovations for compensation in housing constructed prior to 1978 as required by the RRP Rule. According to the EJ Screen, the renovation did occur in an area of potential EJ concern for indexes in the State Percentile and National Percentile. Respondent agreed to pay a penalty amount of $1,000.
