EPA obtained evidence that Dan?s Diesel Performance, Inc., offered for sale and sold defeat devices, which rendered inoperative emission control systems on EPA-certified motor vehicles or motor vehicle engines, specifically, DDP sold at least 2,296 parts or components that disable, remove, bypass, defeat, or render inoperative air pollution emission control systems installed on or in motor vehicles and motor vehicle engines in compliance with Title II of the CAA. EPA filed a FOV in September of 2020.
EPA signed a Consent Agreement and Final Order (CAFO) with Dan?s Diesel Performance, Inc., Machesney Park, Illinois to resolve violations regarding Section 203(a)(3)(B) of the Clean Air Act (CAA) in August of 2023. The CAFO requires Dan?s Diesel Performance, Inc., to pay a penalty of $256,151 and perform a Diesel School Bus SEP, valued at $375,000, and resolves the FOV issued to Dan?s Diesel Performance, Inc., on September 23, 2020.
