Summary

On August 28, 2023, EPA issued an Administrative Order (AO) establishing a schedule for the Town to design and construct a tidal discharge outfall diffuser for its WWTF to control total ammonia-nitrogen, total copper, and total nickel in accordance with the Town�s NPDES permit. The Town of Salisbury, Massachusetts owns and operates a wastewater treatment facility (WWTF) that discharges to an unnamed tidal creek that flows to the Merrimack River. The WWTF is unable to meet its National Pollutant Discharge Elimination System Permit (NPDES) limits for total ammonia-nitrogen, total copper, and total nickel. The Order also establishes interim limits for these pollutants. Massachusetts has not been delegated the Clean Water Act program, but EPA worked in close coordination with the Massachusetts Department of Environmental Protection on this matter.
