On August 24, 2023, Region 3 filed a Consent Agreement and Final Order settling an administrative enforcement action against TD 88 LLC T/A Baymart Liquors ( Baymart ), the owner of three underground storage tanks (USTs) located at Baymart Liquors in Annapolis, MD. The violations alleged include failure to conduct line leak detector testing for two tanks, and failure to perform annual line tightness testing or monthly monitoring of pressurized piping for two tanks. The settlement required Baymart to certify that it is now in compliance with applicable UST requirements and to pay a civil penalty of $46,322, in two installments over 90 days, including interest, for a total of $46,497.72. The facility is not located in an area of potential EJ concern. The Maryland Department of the Environment was informed of this enforcement matter.
