The week of August 14, 2023, EPA Region 6 issued a Consent Agreement and Final Order ( CAFO ) under its authority pursuant to the Resource Conservation and Recovery Act ( RCRA ) to Nouryon Surface Chemistry LLC ( Nouryon ) located in Houston, TX. The CAFO was issued in response to violations of:
i) Failure to file an adequate or accurate initial or subsequent notification of RCRA activities; and
ii) Failure to have a contingency plan that contains the elements set forthe in 40 C.F.R. 262 Subpart M.
The CAFO requires Nouryon to:
A) Revise its contingency plan to describe the arrangements made with local responders, includes names and emergency telephone numbers for emergency coordinators, and includes a list of emergency response equipment and their capabilities.
B) Pay a civil penalty of five hundred twelve dollars ($512).
Nouryon must respond to EPA Region 6 within ninety (90) days of filing. The penalty must be paid within thirty (30) days of filing.
