On August 29, 2023, Region III filed a Consent Agreement and Final Order regarding two hundred and fifteen (215) violations of FIFRA in connection with the distribution and/or sale of misbranded pesticides. This enforcement action furthers FIFRA's purpose of promoting environmentally safe and effective pesticide use and prevents the potentially harmful use of pesticides. EPA became aware of the unlawful sale and distribution of the misbranded pesticides through an inspection conducted by the District of Columbia's Department of Energy and Environment. The Consent Agreement alleges that Plant Cell Technology, Inc. violated FIFRA and EPA's Pesticide Program regulations by failing to properly label its registered pesticide Plant Preservative Mixture (EPA Reg. No. 71806-1). Under the terms of the settlement, Plant Cell Technology, Inc. will pay a civil penalty in the amount of $35,000.00 to resolve these two hundred and fifteen (215) violations. EPA notified the District of Columbia's Department of Energy and Environment regarding this matter, and the District of Columbia has raised no objections.
