Summary

On August 31, 2023, EPA issued a Clean Water Act Administrative Order for Compliance (Order) to Everett's Auto Parts, Inc. (EAP) which addresses non-compliance with the conditions of the National Pollutant Discharge Elimination System (NPDES) Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity (MSGP). EAP is a used auto parts dealer, warehouser, and scrap metal seller located in Brockton, Massachusetts. Under the Order, EAP will be required to come into compliance with MSGP requirements, update its Stormwater Pollution Prevention Plan, and submit evaluation and implementation plans for pollution prevention Best Management Practices at each of its identified stormwater outfalls. The NPDES program has not been delegated to Massachusetts, but the Massachusetts Department of Environmental Protection supports issuance of this Order. The facility is located in an area of environmental justice concern.
