On August 31, 2023, EPA Region III entered into a Consent Agreement and Final Order with Schuster Concrete Ready Mix, LLC ( Schuster ) resolving alleged violations of the Subpart JJJJJJ National Emissions Standards for Hazardous Air Pollutants ( NESHAP ) for Industrial, Commercial, and Institutional Boilers Area Sources ( Subpart JJJJJJ ) against Schuster, in connection with Respondent's failure to keep any of the records required by Subpart JJJJJJ. Specifically, EPA alleged that Respondent failed to keep records required by 40 C.F.R. 63.11225 (c) and keep these records in a form suitable and readily available for expeditious review per 40 C.F.R. 63.11225 (d) for seven oil fired boilers located at five different Schuster facilities. All five Schuster facilities are located in EJ areas of concern. The Maryland Department of Emergency Management is aware of this action. The settlement requires Respondent to pay $147,497 in civil penalties to resolve the alleged violations.
