On August 28, 2023, Region 1 filed a Consent Agreement and Final Order (CAFO) both initiating and resolving allegations against Stavro Fine Finishes, LLC, dba Fresh Coats Painting (Respondent) of violations of Section 409 of the Toxic Substances Control Act (TSCA), 15 U.S.C. 2689, and the Renovation, Repair, and Painting Rule (RRP Rule) set forth at 40 C.F.R. Part 745, Subpart E. These alleged violations arise from Respondent's renovation activities conducted in Connecticut. Specifically, EPA alleged that Respondent failed to cease renovations without obtaining firm recertification, obtain a written acknowledgement from the owners of the renovated properties that the owners received the Renovate Right pamphlet or other EPA-approved pamphlet, ensure that certified renovators performed renovations or were trained and directed by certified renovators, and retain the necessary records to demonstrate compliance with residential property renovation for a period of 3 years. The CAFO requires Respondent to pay a civil penalty of $18,454 over a six-month period. One of Respondent's renovation projects was located in an area of environmental justice concern. The RRP Rule is enforced only by EPA.
