Notice of Warning issued pursuant to FIFRA section 14(a)(4), 7 U.S.C. ? 136l(a)(4) and notifies Sea to Summit North America LLC (Sea to Summit), located in Boulder, Colorado, that it has violated FIFRA section 12(a)(2)(N), 7 U.S.C. ? 136j(a)(2)(N), for failing to file reports required by the Act. Specifically, Sea to Summit violated 7 U.S.C. ? 136j(a)(2)(N) by failing to file a Notice of Arrival of Pesticides and Devices, EPA form 3540-1 before importing a shipment into the United States. As required by 19 C.F.R. ? 12.112, a Notice of Arrival of Pesticides and Devices, EPA form 3540-1 including a copy of one product label, must be submitted prior to the arrival of a shipment in the United States.
