This Consent Agreement and Final Order (CAFO) for Bluewater Gas Storage, LLC (Bluewater Gas), Ray Township, Michigan, resolves violations regarding the New Source Performance Standards for Crude Oil and Natural Gas Facilities for which Construction, Modification, or Reconstruction Commenced after September 18, 2015 (NSPS Subpart OOOOa).
On December 21, 2022, Bluewater Gas submitted to EPA a periodic report due pursuant to 40 C.F.R. ? 60.5420a(b)(7). In the December 21, 2022 periodic report, Bluewater Gas identified four connectors, among other components, that had been found to be leaking during a required fugitive emissions components survey conducted February 2, 2022 and for which Bluewater Gas had not made a first attempt at repair within 30 days, as required by 40 C.F.R. ?60.5397a(h)(1).
On February 22, 2023, Region 5 issued a Finding of Violation to Bluewater Gas for failing to make a first attempt at repair and to make a final repair of leaking fugitive emissions components within the timeframe required by NSPS Subpart OOOOa at its Omo Road Compressor Station.
As the repairs to the leaking components have been completed, there is not a concurrent ACO in this matter.
This CAFO requires Bluewater Gas to pay a penalty of $49,885 and resolves the FOV issued to Bluewater Gas on February 22, 2023.
