Summary

The site is a residential property where, on July 13, 2023, approximately 50 5-gallon containers of an unknown flammable liquid were placed in an earthen pit and lit on fire, causing an explosion and fire. The 5-gallon containers originated from Millenia?s warehouse. An initial assessment of conditions on-site found 577 containers at the site, some in poor condition. Of the 577 containers, 553 containers were labeled with safety data sheets stating the containers? contents included ethyl acetate, butyl acetate, and styrene. Those 553 containers also had ?Flammable Liquid? warning labels. Millenia and Mr. Le are liable as owner/operators at the time of disposal under CERCLA ? 107(a)(2). Burrton Lake House is liable as a current owner under CERCLA ? 107(a)(1). The ASAOC will require Millenia, Mr. Le, and Burrton Lake House to complete removal of hazardous waste at the site, as well as provide financial assurance in the amount of $200,000 and pay EPA?s future response costs at the Site.
