On September 21, 2023, Region 3 filed a Consent Agreement and Final Order, simultaneously commencing and concluding an administrative enforcement action, against Davis GMC Truck, Inc. for RCRA I and Virginia federally authorized underground storage tank program violations at the UST facility located at 2707 W 3rd Street, Farmville, VA 23901 (the Facility ). The Facility is an automobile dealership with one 3,000-gallon UST for regular gasoline. The violations alleged include failure to monitor for releases at least every 30 days; failure to test spill prevention equipment at least once every three years; failure to inspect overfill prevention equipment at least once every three years; failure to conduct walkthrough inspections; failure to designate Class A and Class B operators and maintain a list of current designated operators; and failure to train Class A and Class B operators as soon as practicable. Violations such as these can potentially lead to petroleum product leaks which can be harmful to both human health and the environment. The settlement required the Facility to certify that it is now in compliance with applicable UST requirements and to pay a $58,449.00 penalty in accordance with a payment installment plan. The Facility is located in an area of potential EJ concern. EPA notified the Virginia Department of Environmental Quality in advance of this action, and the Department had no objections.
