The Regional Judicial Officer issued a Final Order on September 20, 2023, ratifying the Consent Agreement to commence and settle a penalty action to resolve violations of TSCA Section 409 against Pella Mid-Atlantic, Inc. (PMA); PMA owns and operates a window and door sales and installation company located in Beltsville, MD. PMA conducts renovations at residential properties in Maryland, Virginia, and Washington, D.C. The Consent Agreement alleges that PMA failed to comply with the Renovation, Repair, and Painting Lead-Based Paint Rule (RRP Rule) when, at a renovation performed at a residence in Washington, DC, it failed to adequately contain interior and exterior work areas so that no dust or debris leaves the work area and when it failed to clean the house until no dust or debris remains after the renovations. The Settlement provides that PMA will pay a penalty of $10,000. EPA directly implements enforcement of TSCA; Maryland is aware of this action.
