On September 27, 2023, Region 3 filed a consent agreement and final order, simultaneously commencing and concluding an administrative enforcement action, against SPS Technologies, LLC for RCRA C and Pennsylvania federally authorized hazardous waste program violations at the facility in PA. This facility is primarily a manufacturer of specialty fasteners made for airplanes of private and government entities. The violations alleged include operating without a permit; failure to make hazardous waste determinations; failure to keep containers of hazardous waste closed; and failure to maintain an adequate contingency plan. This administrative enforcement action provides an incentive for SPS Technologies, as well as similarly situated companies, to properly manage hazardous waste at their respective facilities. The settlement required this facility to certify that it is now in compliance with applicable hazardous waste requirements and to pay a $109,805.00 penalty. This facility is not located in an area of potential EJ concern. EPA notified the Pennsylvania Department of Environmental Protection in advance of this action, which had no objections.
