On August 22, 2023, EPA entered into an Expedited Settlement Agreement (ESA) with Eastern Packaging, Inc. of Lawrence, Massachusetts that resolves alleged violations of the Resource Conservation and Recovery Act (RCRA). Eastern Packaging, a low-density polyethylene plastic bag manufacturing and flexographic printing facility, allegedly violated several provisions of the RCRA program, including failure to train and have a complete training plan, minimize the threat of release, have a complete contingency plan and distribute the contingency plan, and conduct an adequate waste determination. The company also had multiple container management violations. The ESA requires compliance and the payment of total penalties of $15,000. EPA conferred with the Massachusetts Department of Environmental Protection prior to the action and provided a copy of the completed action to the state. The facility is located in an area of potential environmental justice concern.
