On September 21, 2022, an authorized representative of the EPA conducted an inspection of the Respondent?s facility to determine compliance with Risk Management Plan (RMP) regulations promulgated at 40 C.F.R Part 68 under Section 112(r) of the Clean Air Act. EPA alleges that the Respondent failed to maintain a description and basis of the worst-case scenario in its Hazard Assessment documentation in violation of 40 C.F.R. ? 68.39(a), failed to document implementation of management of change procedures related to upgrade of defrost controls in violation of 40 C.F.R. ? 68.75(a), and failed to document coordination with local authorities in violation of 40 C.F.R. ? 68.93(c).
