On September 26, 2023, the Region filed an Expedited Settlement Agreement which settled EPA's penalty claim for violations of CWA Section 311(j) at the US Steel Mon Valley Works-Clairton facility located in Clairton, Pennsylvania. The facility failed to describe in the SPCC Plan the physical layout of the facility and include a facility diagram, failed to ensure that the SPCC Plan addresses the type of oil in each container and its storage capacity, failed to provide complete discussions pertaining to Facility tank car and tank truck loading/unloading racks, failed to provide sufficiently impervious secondary containment for the largest single container, failed to regularly test or inspect aboveground containers for integrity and whenever material repairs are made, failed to promptly correct visible oil leaks from containers and remove accumulated oil, failed to locate mobile or portable oil storage containers to prevent oil discharges and provide secondary containment, failed to provide complete discussion pertaining to the facility transfer operations, pumping, and in-plant processes, and failed to Inspect aboveground valves and piping regularly, and conduct integrity and leak testing of buried piping. The respondent has agreed to pay a cash penalty of $4,900 to settle the matter.
