On January 8, 2024, Region 10 filed a consent agreement and final order resolving violations of the Clean Water Act by Four Star Supply, Inc. (Respondent)] for its petroleum fuel storage and distribution facility in Pullman, Washington. Respondent failed to adequately implement Clean Water Act Section 311 spill prevention, control and countermeasure (SPCC) requirements which resulted in numerous SPCC 40 C.F.R. Part 112 violations including lack of adequate secondary containment volume and imperviousness and failure to implement oil storage tank integrity testing and inspections. Respondent's failure to adequately implement its SPCC Plan was a contributing factor to a diesel fuel spill from a leaking fuel tank into inadequately impervious secondary containment that discharged leaked fuel to the Palouse River in April 2022. This action ensures the Respondent will take other SPCC implementation measures at its other Palouse regional fuel storage facilities as means to protect regional surface waters from oil spills. The Respondent has agreed to pay a penalty of $111,000 and has returned to compliance currently at its Pullman location.
