EPA Region 5 is entering into a Consent Agreement and Final Order (CAFO) for Decorative Panels International, Inc. (DPI), Alpena, Michigan to resolve violations regarding the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Plywood and Composite Wood Products (PCWP) at 40 C.F.R. Part 63, Subpart DDDD.
On November 1, 2018, and March 14 and 15, 2019, DPI conducted performance tests at its No. 1 Biofilter which showed that DPI was violating the NESHAP for PCWP by failing to demonstrate compliance with at least one of the six compliance options of Table 1B to Subpart DDDD at its No. 1 Press. DPI conducted a performance test on Biofilter No. 3 on October 14, 2020, which demonstrated compliance with at least one of the six compliance options of Table 1B to Subpart DDDD. Per 40 C.F.R. ? 63.2271(a) and Part 63, Subpart DDDD, Table 7, DPI was required to conduct a performance test on Biofilter No. 3 within 2 years following the previous performance test, or no later than October 14, 2022. DPI did not conduct the required performance test on Biofilter No. 3 until November 29, 2022, 46 days late, in violation of 40 C.F.R. ? 63.2271(a) and Part 63, Subpart DDDD, Table 7.
This CAFO requires DPI to pay a penalty of $73,000, and resolves the violations incurred by DPI between November 1, 2018 and August 22, 2019; and between October 14, 2022 and November 29, 2022.
