The products in the shipment described above were in violation of 40 C.F.R. ? 156.10 (a)(1)(ii) and 40 C.F.R. ? 156.10 (a)(1)(v) because the label for the unregistered diazinon did not have the name and address of the producer or the producing establishment number. Therefore, the pesticide was misbranded pursuant to Section 2(q)(1)(D) of FIFRA, 7 U.S.C. ? 136(q)(1)(D).
