On December 19, 2023, EPA entered into a Clean Water Act administrative order on consent (AOC) with Granite Shore Power Merrimack LLC of Bow, New Hampshire. The AOC sets out a schedule for the company to come into compliance with its National Pollutant Discharge Elimination System (NPDES) permit's requirement to cease discharge of bottom ash transport water (BATW). The AOC also contains interim BATW discharge limits and requires the company to use best management practices. The New Hampshire Department of Environmental Services is supportive of EPA's action.
